The President of Russia endorsed the Federal Law of 29.07.2018 No.262 “On amendments being made to the “Federal Law on accreditation in the Federal Service for Accreditation” and particular laws of the Russian Federation relating to the improvement of accreditation procedure”. The Federal Law was devised by the Ministry of Economic Development with contributions made by the Federal Service for Accreditation and in consultation with business-community and the largest business associations.
The document amends the federal laws “On accreditation in the Federal Service for Accreditation”, “On advertising”, and in the Administrative Offences Code of Russia.
The Federal Law simplifies particular administrative procedures for law-abiding accredited entities, which will cut their expenses (a paper-based accreditation certificate stops being used; some processes of interaction between the Federal Service for Accreditation and accredited entities are digitized; a new process of an accreditation area updating is created). The new regulation broadens and clarifies the jurisdiction of the Federal Service for Accreditation, particularly, it is vested with a right to form technical commissions and groups which would decide on the applicant accreditation, establish the rules of professional integrity of accreditation experts, approve accreditation guidelines mandatory for candidates and accredited persons and ensuring their compliance with accreditation criteria.
The law is amended with the provisions establishing the peculiarities of accreditation by the national accreditation agency in particular fields of work. Particularly, it establishes the procedure of accreditation of entities dealing with voluntary certification.
The law provides for new instruments of combating dishonest accredited entities which help detect and disqualify certificates granted without necessary testings, which significantly reduce the market costs of services and lead to the unprofitableness of works subject to all requirements.
The law develops the current provisions related to the application of risk-oriented approach by the Federal Service for Accreditation within the Federal government control over the activities of accredited entities.
An amendment to the law “On advertising” prohibits advertising of certification services offered by entities with no accreditation of the Federal Service for Accreditation, or by accredited entities which don’t provide the actual accreditation register number.
Some provisions of the Federal Law are aimed at supporting Russian export by means of cutting expenses on certification and testing abroad. Particularly, bilateral accreditation programs will be possible. This draft law has become a crucial step on the way to forming the Federal Service for Accreditation in full compliance with international accreditation standards.
